Tender summary
The Independent Informal Dispute Resolution (IIDR) process is required under Section 61111 of the Patient Protection and Affordable Care Act of 2010 (the Affordable Care Act) (Pub. I., 111-148) enacted on March 23, 2010. State Operations Manual (SOM) Chapter 7, 7213 provides details on the process for nursing homes. The PEER review Organization chosen will provide IIDR services for the State of Mississippi, State Department of Health, Office of Licensure, Division of Health Facility Licensure and Certification, as agreed by contract with the centers for Medicare and Medicaid Services (CMS). The IIDR process allows Long Term Care facilities to dispute if deficiencies cited by the State Agency were accurate; and gives them the opportunity to submit documentation to the PEER Review Organization for an Independent Informal review. If after desk review, the PEER Review Organization determines that there is sufficient evidence to overturn the deficiency, then a recommendation is made to the State Survey Director to consider removal. The State Survey Director has the final determination on whether or not to remove the deficiency.
